Removal Proceedings

A removal proceeding usually begins with issuance of a Notice to Appear, formerly called an Order to Show Cause in a deportation proceeding, issued by Immigration and Customs Enforcement (ICE), the enforcement part of the Department of Homeland Security. The terms removal and deportation have the same meaning. Removal is a more recent term, while deportation is a term previously used for the same process.

A Notice to Appear sets out the allegations and basis for removal, but getting a Notice to Appear does not necessarily mean that an individual will automatically be deported. In most cases, the immigrant has the right to contest removal by defending against the charges and requesting review by an immigration judge. An individual who receives a Notice to Appear should contact a deportation defense lawyer immediately.

U.S. law provides many reasons for removal (deportation) of an immigrant. Some of the common grounds for initiation of deportation proceedings include:

  • Certain criminal convictions

  • Immigration status violations

  • Unlawful employment

  • Overstaying a visa

  • Entering the U.S. illegally

  • Immigration fraud

  • Failure to maintain nonimmigrant status

Regardless of the reason, legal remedies and actions are available to contest the removal. But getting help from an experienced deportation defense lawyer is essential.

Defenses to Removal

An immigrant facing deportation usually has the right to contest the removal by filing an application for relief or protection from removal with the immigration court or the Board of Immigration Appeals. In some cases, multiple hearings are necessary. Getting help from an experienced deportation defense lawyer is critical, no matter what the circumstances of the removal proceeding are. Very specific procedures must be followed, and detailed information must be properly submitted. A mistake in the process can create significant complications.

Eligible individuals in a removal proceeding may be able to apply and qualify for immigration benefits, such as adjustment to lawful permanent resident status, cancellation of removal, and certain waivers of inadmissibility. Seeking asylum or withholding of removal, or demonstrating that there is not a valid basis for removal, are among other defenses that also may be available. The best approach for an individual depends entirely on the circumstances surrounding the removal proceeding.

The deportation process can move quickly. While some cases may require multiple hearings before an immigration judge, a noncitizen may sometimes be subject to expedited removal without a hearing. In any case where an individual receives a Notice to Appear or has reason to think that one will be issued, contacting a deportation defense lawyer as soon as possible is absolutely essential.
